1. Overview
Welcome to ShopSmartNow.
These Terms of Service govern your access to and use of the website shopsmartnow.net, including any purchases made through the website.
Throughout these Terms, “ShopSmartNow”, “we”, “us” and “our” refer to the operator of ShopSmartNow. “You” and “your” refer to any person accessing the website or purchasing our products.
By accessing our website, creating an account or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Return & Refund Policy.
If you do not agree to these Terms, you should not use the website or place an order.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded, including rights under the Australian Consumer Law.
2. Eligibility and customer information
You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through our website.
When placing an order, you agree to provide accurate, complete and current information, including your:

You are responsible for checking your order and delivery information before submitting it.

Actual colours and appearance may vary slightly depending on your screen, lighting conditions and device settings.
Product packaging may occasionally differ from the packaging displayed, provided that the product remains materially consistent with its description.
Product availability, features and specifications may change. We may discontinue a product or limit the quantity available where reasonably necessary.
Products must be used according to the instructions, warnings and intended purpose shown on the product page or packaging.
Nothing in this section limits your rights when a product is faulty, unsafe, does not match its description or otherwise fails to meet a consumer guarantee.
4. Orders and acceptance
Submitting an order constitutes an offer to purchase the selected product.
An order is accepted when we send confirmation that the order has been accepted or has entered processing.
We may reasonably decline or cancel an order where:
- Payment cannot be authorised
- Information supplied appears incorrect or fraudulent
- A product is unavailable
- There is an obvious pricing or listing error
- The delivery address cannot be serviced
- The order appears to involve unlawful activity or unauthorised resale
If we cancel an order after receiving payment, we will return the applicable amount to the original payment method.
Please contact us immediately if you need to change or cancel an order. We cannot guarantee that changes can be made after an order has entered processing or been submitted to a fulfilment partner.
5. Prices and payments
All prices displayed on the website are in Australian dollars unless stated otherwise.
The amount payable will be shown at checkout before you submit your order.
Standard shipping within Australia is currently free, subject to our Shipping Policy.
Payments may be processed through Shopify Payments, PayPal or another payment provider displayed at checkout.
You confirm that you are authorised to use the payment method selected.
We do not store complete payment-card details. Payment information is handled by the applicable payment provider in accordance with its own security and privacy practices.
Promotional offers, discount codes and prices may be changed or withdrawn, but this will not alter the price of an order that we have already accepted.
6. Shipping and delivery
ShopSmartNow currently delivers to eligible addresses within Australia.
Some products may be dispatched directly to customers by selected international fulfilment partners.
Processing and delivery estimates are displayed in our Shipping Policy. Delivery times are estimates and may be affected by carrier disruptions, public holidays, severe weather, customs processing or other circumstances outside our reasonable control.
We remain responsible for assisting with orders that are lost, damaged, delivered incorrectly or not supplied as agreed.
If a delivery appears delayed or missing, contact us at support@shopsmartnow.net with your order number so that we can investigate.
Providing an estimated delivery date does not remove any rights that you may have under the Australian Consumer Law.
7. Returns, refunds and Australian Consumer Law
Returns, cancellations and change-of-mind requests are handled in accordance with our Return & Refund Policy.
Our change-of-mind policy is provided in addition to, and does not replace, your rights under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Depending on the nature and seriousness of a problem, an available remedy may include a repair, replacement, refund or compensation for reasonably foreseeable loss or damage.
We may reasonably ask for photographs, video or other information needed to assess a reported issue.
We will not require customers to resolve an eligible consumer-guarantee claim directly with the manufacturer or overseas supplier.
8. Acceptable use
You may use the website only for lawful purposes.
You must not:
- Use the website fraudulently or unlawfully
- Attempt to gain unauthorised access to the website or another customer’s account
- Introduce viruses, malicious software or harmful code
- Interfere with the website’s security or operation
- Collect another person’s personal information without authority
- Use automated systems to overload, disrupt or improperly extract information from the website
- Copy or commercially exploit our website content without permission
- Misrepresent your identity or payment authority
- Infringe our rights or the rights of another person

Our store is hosted by Shopify, which provides the ecommerce platform used to offer products and process orders.
Purchases made through ShopSmartNow are transactions directly between you and ShopSmartNow. Shopify is not the seller of our products.
The website may use third-party services for payments, order processing, fulfilment, analytics, communications and delivery.
These providers may have their own terms and privacy practices. We are not responsible for independent third-party websites that you voluntarily access through external links.
Nothing in this section removes our responsibility as the seller for complying with applicable consumer laws.
10. Intellectual property
Unless otherwise stated, the website design, ShopSmartNow branding, original text, graphics and other original content are owned by or licensed to ShopSmartNow and are protected under applicable Australian and international intellectual-property laws.
You may use the website for personal and non-commercial shopping purposes.
You must not reproduce, sell, republish, modify or commercially exploit protected website content without written permission, except where permitted by law.
Third-party names, images and trademarks remain the property of their respective owners.
11. Reviews and feedback

15. Suspension and termination
We may suspend or terminate access to a customer account where we reasonably believe that:
- The account is being used fraudulently or unlawfully
- The customer has materially breached these Terms
- Suspension is necessary to protect the website, customers or payment systems
- We are required to do so by law or a payment provider
Where reasonably practical, we will provide notice and an opportunity to address the issue.
Termination does not remove any existing payment obligations, accepted orders or consumer rights.
16. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be read down or removed only to the extent necessary.
The remaining provisions will continue to operate.
17. Changes to these Terms
We may update these Terms to reflect changes to our business, services, technology or legal obligations.
The current version will be published on this page with an updated revision date.
Changes will not retrospectively remove rights relating to orders accepted before the updated Terms took effect.
18. Governing law
These Terms are governed by the laws of New South Wales and the applicable laws of Australia.
You and ShopSmartNow submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales and Australia.
This section does not prevent a customer from exercising any right to bring a claim in another jurisdiction where applicable law allows it.
